These Terms of Use form the agreement that governs your use of Formisse (the "Service"). By accessing or using the Service, you agree to these terms.
1. Acceptance of the terms
By accessing or using the Service, you accept these terms and the Privacy Policy. If you do not accept the terms, you should not use the Service.
If you are using it on behalf of an organisation, you represent that you are authorised to bind that organisation to these terms.
2. Description of the service
Formisse is a software service that lets you build forms, publish them in various ways, collect responses in one panel and analyse them with AI. We may improve, change or remove features from time to time.
3. Your account
You are responsible for keeping your account details confidential and for all activity under your account. You agree to provide accurate, up-to-date information and to be of the legal age required to use the Service.
4. Acceptable use
You may not use the Service:
- For unlawful, harmful, deceptive content or content that infringes the rights of others,
- To send spam, malware or unsolicited bulk messages,
- To compromise system security, reverse-engineer, or attempt unauthorised access,
- In a way that overloads the Service or degrades the experience of other users.
5. Your content and data
All data you collect through your forms belongs to you. You grant us permission to process that data on your behalf to the extent needed to provide the Service.
You are solely responsible for the content and lawfulness of the data you collect and for obtaining any required consents. You decide what information to ask for on your forms and what kind of documents (such as invoices, receipts or IDs) are collected in uploaded files; we do not determine or pre-approve that content.
Accordingly, Formisse is not responsible for the nature of the data you collect through your forms or for any consequences arising from its processing; that responsibility rests entirely with you as the data controller.
6. Subscription and payment
We offer a free plan; paid plans are billed in advance for the period you choose and renew automatically at the end of the period.
You can upgrade, downgrade or cancel your plan at any time. Refund terms are explained in our Refund Policy.
7. Intellectual property
The Formisse brand, software, design and content belong to us or our licensors. Using the Service does not grant you any ownership of or licence to these rights.
8. Availability and changes
We aim to provide the Service without interruption, but temporary outages may occur due to maintenance, updates or causes beyond our control. We may change or discontinue all or part of the Service with reasonable notice.
9. Limitation of liability
The Service is provided "as is" and "as available". To the maximum extent permitted by applicable law, we are not liable for any loss of profit, loss of data or indirect damages arising from your use of the Service.
10. Indemnity
You agree to indemnify Formisse against claims arising from your use of the Service in breach of these terms or applicable law, or from the data you collect through your forms.
11. Termination
If you breach these terms, we may suspend or close your account. You may also close your account at any time; after closure, data is handled as described in the Privacy Policy.
12. Governing law
These terms are governed by and construed in accordance with the laws of England and Wales. Any rights granted to you by consumer law are reserved.
13. Changes to the terms
We may update these terms from time to time. The current version is published on this page and marked with the "last updated" date; we will notify you of significant changes.
